Dogwood notifies attorney general’s office that HCA is in 'potential noncompliance' with Mission sale contract

An independent watchdog has flagged the hospital chain HCA for what it calls "potential noncompliance" with the terms of its purchase of Mission Health. The Dogwood Health Trust, which oversees the sale agreement, sent a formal notice to the North Carolina attorney general's office, citing serious concerns over patient safety and service cuts.

The latest report from the monitor points to repeated threats to patient safety, along with services that have been discontinued or "degraded" since HCA took over. According to the filing, the hospital system has failed to maintain certain critical care standards promised in the original contract. The monitor's findings include a pattern of staffing shortages, delayed emergency care, and the elimination of programs that were supposed to remain in place.

Dogwood's notification to the state signals a breakdown in the oversight process. Under the sale agreement, HCA was required to uphold specific levels of care and access for the region. The monitor's report suggests those commitments are not being met. The attorney general's office now has the authority to investigate and potentially enforce penalties or demand corrective actions.

This is not the first time HCA has faced scrutiny over its management of Mission Health. Previous reports have documented complaints from doctors, nurses, and patients about declining conditions. However, this formal notice raises the stakes, as it triggers a legal mechanism that could lead to binding changes. For now, the community waits to see whether the state will step in to hold the company accountable.
